A MAN 'donkey kicked' a police officer in his genitals after being arrested

Shane Oldham, 24, of Old School Lane, College Estate, Hereford, pleaded guilty to being drunk and disorderly and assaulting two police officers while on a city night out on December 24.

Abbey Kingston, prosecuting, said police were called to outside the Kerry pub in Commercial Street where a number of males had been ejected and officers noticed Oldham in the area.

The policemen asked a number of people to leave the area including Oldham who claimed he had 'not done anything' before walking away.

PC Mark Herbert later saw the defendant with another group of males in Blue School Street before Oldham swore at him.

"He took an aggressive posture towards PC Herbert raising his fists, the officer thought he was about to be struck," added Mrs Kingston.

"PC Daniel Moore took Oldham to the ground and arrested him for being drunk and disorderly. As officers were putting him into the back of their police vehicle Oldham kicked out causing a graze to PC Mason's shins.

"Oldham was then seen to be looking over his shoulder and donkey kicking Herbert in his genitals."

On interview Oldham said he was out with his friends and had drunk four or five lagers so was 'probably drunk' as he couldn't remember a thing.

Matthew Lewis, mitigating, said the Oldham understood the seriousness of the crime and had previously been given a community order last year on a different incident of assault and threatening behaviour.

Magistrates adjourned the case for two weeks for a probation report to be completed.
