A MAN celebrating his 25th birthday who crashed his mum's car after he took it to drive to McDonald's has been fined and disqualified from driving.

Callum Gibbs of Oldwood Road, Tenbury Wells pleaded guilty to aggravated vehicle taking and vehicle damage under £5,000, and to driving a car without a licence and third party insurance.

Roxanne Maiden, 21, of Park Street, Kidderminster, pleaded guilty to travelling in a car which she knew had been taken without consent of the owner.

Herefordshire Magistrates Court heard that on December 5 Gibbs and his then partner, Maiden, were at his mum's house in Tenbury Wells celebrating his birthday.

Adrian Jones, prosecuting, said Gibbs' mum fell asleep early in the evening and Gibbs then decided to take her car to drive to Bewdley and then to McDonald's in Kidderminster.

At 3.30am Gibbs made a 999 call as he had crashed his mother's car on the A4112 between Leysters and Kimbolton and had become concerned as Maiden said she couldn't feel her arm.

Emma Prosser, defending, said she was aware Gibbs was under a current community order but he has reimbursed his mother for the damage to the car. He was disqualified from driving for 12 months and given a community order for 12 months with ten days rehabilitation activity requirements days. He was also fined £50 and ordered to pay court costs of £150 and a surcharge of £85.

Emily Gourley, defending Maiden, said she had no previous convictions. Magistrates gave her a conditional discharge for 12 months and ordered her to pay a £120 fine, court costs of £150 and a surcharge of £30.
