A KINGTON man who smoked cannabis on his birthday has received a driving ban after the drug was detected in his blood the following day.

Thomas Smith, 28, of The Square, Kington, admitted drug driving before Hereford Magistrates Court last week.

The court heard there was 8.5mg of Delta-9 Tetrahydrocannabinol in his blood.

Kriss Ewing, prosecuting, said Smith was stopped during a routine police check at 6.20pm on February 2 and officers felt he may have had drugs in his system so they requested a test.

There was nothing unremarkable about his driving, she said. He did however have a previous offence of driving with excess alcohol from December 2013.

Marilena Divitantonio, defending, said Smith had been pulled over due to having a loud exhaust.

He had not smoked any cannabis that day, she said, and it had been on a previous day for his birthday.

Magistrates disqualified Smith from driving for three years, ordered him to pay a £120 fine, £135 costs and a £30 victim surcharge.
