TO respond to the Malvern For All spokesman Martin Jones promoting the 'modernising' of the Malvern Hills Acts, as they know perfectly well there is no uncertainty about the legal position – the cable car is very clearly illegal under current legislation.
The Malvern For All legal opinion was written by someone who says he has no expertise or experience in this area of law whatsoever.
The existing laws are working exactly as intended, preventing people from building whatever they want on the hills. No new houses have been built on land owned by the Conservators since they were formed.
If anyone tried to weaken ('modernise') the laws protecting the hills to the point Malvern For All could build their cable car, it would inevitably open the possibility of allowing anyone else to build whatever and wherever they wanted.
Little would prevent the hills (and possibly the Commons) from being developed with hotels, fast food outlets and private houses. Many places could never be accessible again.
None of your assertions are supported with any evidence, none of your plans or arguments stand up to any scrutiny, the law is against you, 80 per cent of people voted against you on the e-petitions and opposition is still growing.
It is time you abandoned your plan.
